The Primary Court in Al-Mudhaibi Wilayat recently issued judicial rulings against a commercial establishment and defendants for violating the Consumer Protection Law and its Executive Regulations, adjudging conviction and imposing financial fines.
The facts of the case are summarized in that the Consumer Protection Department in North Al Sharqiyah Governorate received several complaints from a number of consumers, stating that they had agreed with a commercial establishment to fabricate doors, windows, and cabinets. However, the establishment failed to complete the works within the agreed timeframe and continued to delay execution and completion of the works, which constitutes a violation of the provisions of Article (23) of the Consumer Protection Law issued by Royal Decree No. (66/2014). This prompted the consumers to submit their complaints to the Department, which, in turn, examined the complaints. As no amicable settlement satisfactory to the parties was reached, the complaints were referred to the judicial authorities, which issued a judgment convicting the establishment and its representatives of the misdemeanor of (failure to provide the service properly to the consumer), as well as the misdemeanor of the provider’s failure to deliver to the consumer a document or invoice written in the Arabic language containing the basic data related to the service. The court further ruled to penalize them with financial fines totaling (1,800) Omani Rials.
The Consumer Protection Authority urges all traders and providers to comply with the provisions of the Consumer Protection Law, its Executive Regulations, and the decisions issued by the Authority, and to adhere to transparency and credibility, and to refrain from misleading promotional practices and false advertisements when promoting goods and services required by consumers.
