For Failure to Repair a Vehicle Defect Judicial Ruling Against a Commercial Establishment in North Al Sharqiyah

The Primary Court in Al-Mudaybi issued a judicial ruling against a commercial establishment and its representative for violating the Consumer Protection Law, due to their failure to provide the service in a proper manner and their failure to issue an invoice in the Arabic language. The judgment ruled for conviction and the imposition of a financial fine. The details of the ruling date back to the Authority receiving a complaint from a consumer, stating that he had contracted with the accused to repair a defect in the vehicle represented by overheating, in addition to fully repainting the vehicle, for a total amount of 255 Omani Rials, of which 70 Omani Rials were paid as an advance. Thereafter, the accused requested an additional amount of 50 Omani Rials, which was handed over, and subsequently requested spare parts, which were provided, on the condition that the work would be completed within two weeks. However, the worker delayed completing the required work within the agreed period, and upon receiving the vehicle, it became apparent that the defect still existed. Accordingly, the consumer returned the vehicle and attempted to have the workshop re-repair it, but to no avail. Upon taking the vehicle from the garage, it became evident that some of the vehicle’s parts were missing, and that he had incurred additional losses to repair the vehicle at another workshop, which prompted him to submit his complaint to the Administration, which commenced its customary procedures. The case was then referred to the Public Prosecution, which in turn initiated the investigation. After completion of the case file, it was referred to the competent court, which issued a judicial ruling providing, first: the conviction of the accused (the owner of the establishment and its representative) of the offense attributed to them by the prosecuting authority, and ruled to fine each accused for the first charge a financial fine, and for the second charge to fine each accused a financial fine. Civilly, the civil claim was referred to the competent civil court. The Consumer Protection Authority affirms the continuation of its efforts in enforcing the laws and protecting consumer rights, and calls upon all establishments and companies to fully comply with the applicable legislation and regulations, stressing that it will take the necessary legal measures against any violations without any leniency.
