The Primary Court in the Wilayat of Al Mudhaibi recently issued a judicial ruling against a commercial establishment in North Al Sharqiyah for violating the Consumer Protection Law and its executive regulations. The ruling included a conviction and a financial fine.
The details of the case pertain to a complaint received by the administration from a consumer alleging that the establishment, with whom he had agreed to service his vehicle, did not carry out the maintenance properly as agreed. Several issues repeatedly appeared in his vehicle at short intervals. Despite repairs by the establishment, the malfunctions kept recurring each time. This prompted the consumer to file a complaint with the administration, which took the necessary steps by appointing a technical expert. The expert’s report confirmed that the establishment did not perform the maintenance correctly on the vehicle. Additionally, the report identified a hidden electrical fault in the dashboard screen system and other issues.
Since no amicable settlement was reached between the consumer and the establishment, the complaint was referred to the Public Prosecution, which investigated and forwarded the case to the competent court. The court issued a ruling convicting the establishment of the misdemeanor of "failing to comply with repair, replacement, or refund obligations." The court imposed a fine of 2,000 Omani Riyals, with the execution of the penalty suspended on the condition that the vehicle is restored to its proper condition without defects as per the warranty and the expert's report regarding the (gearbox) within a month, with all costs to be borne by the establishment.
