The Primary Court in the Wilayat of Barka has issued a judicial ruling convicting a commercial establishment specializing in construction works, along with three of its representatives, for violating the Consumer Protection Law issued by Royal Decree No. (66/2014) and its Executive Regulations. The court sentenced them to six months’ imprisonment and imposed a total financial penalty of 1,500 Omani Riyals.
The details of the case date back to a complaint received by the Consumer Protection Authority in Barka from a consumer who reported that he had contracted with the establishment to custom-fabricate and install granite and washbasins for his residence for a sum of 1,600 Omani Riyals, with an agreed completion timeframe of one month. However, the establishment failed to adhere to the agreement, delivering only part of the goods and continuously delaying the delivery of the remainder.
Following the legal procedures undertaken by the Authority, the complaint was referred to the Public Prosecution, which in turn forwarded it to the competent court. The court convicted the three defendants of the misdemeanor of “failing to provide the service in a proper manner and in accordance with its nature.” The court sentenced the first and second defendants to six months’ imprisonment and a fine of 500 Omani Riyals each, while the third defendant was fined 500 Omani Riyals. The court further ordered them to bear the judicial expenses and referred the civil claim to the competent court.
The Consumer Protection Authority reaffirms the necessity for commercial establishments to comply with the applicable laws and regulations, and to fulfill their obligations towards consumers. It stressed that it will not hesitate to take the necessary legal measures against violators in order to protect consumer rights and ensure the integrity of commercial transactions.
