More than OMR12,000 fines against a commercial establishment in Samail for non-compliance with the performance of the service as agreed

The Court of First Instance in the wilayat of Samail recently issued judgments against a commercial establishment for violating the Consumer Protection Law and its executive regulations. The establishment was found guilty and was ordered to pay fines amounting to over OMR12,000. Additionally, the court ruled that the establishment should cease its activities and close the shop for a period of six months. The case arose from complaints received by the Consumer Protection Administration in Al Dhakhiliya Governorate. Multiple consumers had engaged with the establishment, which specialized in manufacturing and installing doors and windows, to have various items produced, including doors, a staircase fence, and external umbrellas. However, the establishment failed to deliver the products within the agreed-upon timeframe. As a result, the affected consumers lodged complaints with the Consumer Protection Administration. The administration took the necessary steps in response to the complaints and subsequently referred the matter to the Public Prosecution. Following an investigation, the Public Prosecution referred the case to the appropriate court. The court found the establishment guilty of the offense of non-compliance with the agreed-upon service and ordered it to pay fines of OMR550, in addition to legal expenses. Furthermore, the court ruled that the establishment's activity should be suspended, and the shop in question should remain closed for six months. In terms of civil claims, the establishment was also instructed to pay the plaintiffs OMR12,485.
