The Primary Court in Barka recently issued a judicial ruling against a commercial establishment, which included a conviction and the imposition of financial fines for violating the Consumer Protection Law issued by Royal Decree No. (66/2014) and its executive regulations.
The facts of the case are summarized as follows: The Consumer Protection Department in South Al Batinah Governorate (Barka) received a complaint from a consumer who had made an agreement with a blacksmith and aluminum workshop to fabricate a mobile caravan. However, the establishment failed to adhere to the agreed-upon delivery date as specified in the contract. Consequently, the department initiated the necessary procedures. After failing to reach an amicable settlement, the complaint was referred to the Public Prosecution, which began an investigation and subsequently transferred the case to the competent court. The court issued its verdict, convicting the defendants for violating the Consumer Protection Law due to their failure to provide the service properly and in accordance with its nature. The court fined the defendants and ordered them to pay an amount of (1000) Omani Rials to the consumer.
In light of this, the Consumer Protection Authority urges providers to comply with the applicable laws in the field of consumer protection and to fulfill their obligations, as this is essential for preserving the rights of consumers when providing them with goods or services.
