Amicable settlement between a consumer and a construction establishment in North Sharqiya

Wednesday 9 October 2024

As part of its ongoing efforts to safeguard and restore consumer rights, the Consumer Protection Department in North Sharqiya Governorate successfully facilitated an amicable settlement between a consumer and a contracting and building materials company. The agreement allows the consumer to repair defects that appeared in his home after construction. The case began when the Consumer Protection Department received a complaint from a consumer who had contracted a company to build a house for his family. However, a year and a half after the house was handed over, defects began to surface, including the detachment of ceramic tiles, cracks in the outer walls, and issues with waterproofing, among other problems. The consumer had already spent OMR 3,300 on repairs but continued to encounter new construction defects. The consumer then filed a formal complaint with the Consumer Protection Department, which immediately appointed a consultant to assess the situation. The consultant's report confirmed the presence of these defects, estimating repair costs at around OMR 1,700. Consequently, it was agreed that the company would waive the outstanding amount owed by the consumer, while the consumer would take responsibility for covering the repair costs. This resolution highlights the department's commitment to addressing consumer grievances and ensuring fair settlements in the marketplace.
